General terms and conditions MyTrueCompanion – Version on 13 September 2018
Data protection is a very important issue for the company Parazzo AG., Marktgasse 5, 4051 Basel, Switzerland, hereafter "MyTrueCompanion"). For this reason, our customer data are always processed in line with the prevailing data protection regulations (GDPR).
We collect and process personal data to the extent that you put these data at our disposal within the terms of your registration on our website for using the MyTrueCompanion service (hereafter: "MyTrueCompanion") and to the extent that we are authorised to collect, use and process the said data on the basis of your consent.
Personal data
Data of a personal nature include all the information relating to an identified or identifiable person (hereafter: "person concerned"). We differentiate personal data from free profiles and as part of Premium member profiles.
Free profiles
For a free registration, we collect and process the following personal data:
Basic data: first name, email address, password, gender, partner's gender, date of birth.
Critères Personal categories: character traits, height, colour of eyes and hair, length of hair, body shape, ethnic group, profession, education, annual income, alcohol and smoking habits, information about children in the household, religion.
Search profile and other information: country, region, district or area/locality, postcode, personal welcome message, additional information for the profile in various categories.
Your transaction data: username, messages, date of registration, activity on our website, type of access (mobile/computer), internal tracking code, date and time of access, web browser type and version, operating system, IP address, device identifier, mobile phone operator.
Member profile
As part of membership registration, we also collect:
Home address, name, telephone number and payment details. We transmit the credit card data to our contractual payment services provider via a secure connection, and we only register them anonymously.
Purposes of data processing
We use the above-mentioned personal data for the following reasons:
- - To carry out customer services requested by you;
- - To implement and manage customer relations between us and you; for example, to make services available to you, to receive payments, billing and debt collection, as well as for accounting purposes;
- - To check commercial communication between the customer and the customer service staff;
- - Information concerning new or additional MyTrueCompanion products, as well as partners working with MyTrueCompanion and distribution of a newsletter;
- - To conduct market studies, marketing campaigns, market analyses;
- - To respect legal requirements (e.g. safeguarding obligations linked to tax law and company law);
- - To maintain and protect the security of our products and services and our websites by preventing and detecting security risks, fraud or other criminal acts or acts committed with the intention of causing harm;
- - To settle disputes, to apply existing contracts, as well as to exercise and defend legitimate rights.
Processing personal data is necessary for the reasons given above, but also to carry out commercial (contractual) relations with you. Unless explicitly mentioned to the contrary, the legal basis for data processing is Article 6 (1) (b) and (f) of the General Data Protection Regulation or your explicit consent given in line with Article 6 (1) (a) of the General Data Protection Regulation.
Should the above-mentioned data later be used for purposes other than those originally specified when they were collected, we must inform you before any further processing and explain the new purpose. In this way, you can oppose processing of your data for other reasons.
Purposes of data processing
All the data you transmit to us are kept confidential. We do not sell personal data to any third parties.
Fundamentally, your data are not made available to third parties for any use unless you declare your consent or if we are legally authorised and/or obliged to transmit these data.
To the extent that it is legally admitted and necessary, we transmit personal data – in order to respect prevailing legislation or to exercise or defend legitimate rights – to the courts, tax administrations and supervisory authorities. We take all required measures to guarantee protection of your personal data in an appropriate and suitable way.
To the extent it is required to carry out services, we transmit your personal data for the above-mentioned reasons to companies that are members of our group:
- - Payment service providers, purchasers/banks with the aim of carrying out payments.
- - In the event of non-payment: to debt-collection companies in order to defend our business interests.
- - To participating partners / marketing partners & e-mail newsletters.
- - Data can be transmitted to specialised service-providers in order to prevent or combat fraud by customers and/or third parties.
Duration of data storage
If no explicit duration for data storage is given when data are collected (e.g. as part of a declaration of consent), personal data are deleted when they are no longer needed to carry out the purposes of storage, unless legal retention obligations oppose deletion (e.g. obligations for data storage relating to business law or tax law).
Rights of individuals concerned: right to information, rectification, deletion or restriction of processing of your personal data, right to oppose and right to transmit data
On request, we will inform you in writing, according to prevailing law, if personal data – and if so, which data – are registered by our company. If you sign up as a user, we provide the possibility for you to consult your data and, if necessary, to modify or delete them yourself. Should erroneous information be registered despite the efforts of our company regarding security and accuracy of data, and if you are not able to correct your data, we will rectify them at your request.
You also have the right to demand a restriction to processing of personal data by our company. Moreover, you can ask to receive the data you have made available to our company in a structured, clear and computer-readable format. You can also oppose processing of your personal data by our company.
Moreover, you have the right to request the deletion of your personal data providing that no legal safeguarding time limit opposes this. We delete data when we no longer need them for the purposes for which they were collected and processed, or when you withdraw your consent, and there is no other legal basis to justify subsequent processing of your data. Moreover, we will delete these data when processing has been illegitimate for reasons unknown to us or when you have opposed processing of your data, and there is no legitimate prior interest in favour of processing them. Your data are also deleted when we are obliged to do so by prevailing legislation. Our company has also implemented technical measures aiming to inform all recipients of your data of your request to delete or rectify them. This only applies in cases when we have disclosed or published these data. All the links, copies and duplicates of your personal data must be deleted.
If you have agreed to processing your personal data, you have the right at any time to withdraw this consent with future effect. Data processing does not become illicit retroactively due to withdrawal of your consent.
Transmission of data to our company is optional. These data are, however, required as part of the contract or to answer your requests. If you do not wish to communicate your data, the contract may not be possible or your requests will not be answered. The data must be available to conclude the contract.

Protocol data
When you access our company's website, your web browser automatically transmits the following data (hereafter: "protocol data"), for technical reasons, to our company's web server; the company enters these data in log files:
- - Date and time of access, URL of website redirecting the customer, file consulted, quantity of data transmitted, browser type and version, operating system, IP address, domain name of your internet service provider.
On this occasion, only information is concerned which allows for no deduction to be made about an individual. This information is technically required to correctly display the web content you have requested and which must be provided for any use of internet services. Protocol data are analysed only for statistical reasons with the aim of optimising our company's presence on the internet and underlying technologies, and are immediately deleted afterwards.
Protocol data are saved separately from other data collected by our company as part of its use.
Google Analytics:
MyTrueCompanion also uses Google Analytics, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, a web analysis service provided by Google Inc. (hereafter: "Google"). Google Analytics uses what are known as "cookies", that is, text files saved on the client's computer and designed to analyse the customer's use of the website. The information created by the cookie concerning use of this website (including the IP address) is transmitted to a Google server in the United States and is saved there. Google uses this information to analyse use made of the website by the client, to establish analyses of the website activities for the operators of the website concerned, and to provide other services linked to use of the website and the internet. If need be, Google also transmits this information to third parties to the extent that it is required by the prevailing laws or to the extent that the third parties carry out data processing on behalf of Google. Google will never link the client's IP addresses with other Google data. Clients have the right to prevent installation of these cookies by using the corresponding settings on their web browers. However, clients are informed that, in this case, they may not be able to make full use of all the features on the website. Google AdWords (remarketing)
MyTrueCompanion also uses the remarketing feature as part of the Google AdWords service. Google AdWords is an online advertising programme provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). With the remarketing feature, we can present users of our website with advertisements based on their interest in other websites within the Google display network (on Google directly, "Google Ads" or on other websites). To do so, the interaction of users of our website is analysed, for example: which offers the user is interested in – so that customised advertisements can be displayed to the user on other websites, also after the visit to our website. To do so, Google records a number on user browsers visiting some Google services or some websites in the Google display network. Using this number designated as a "cookie", the visits of these users are recorded. The number is used to uniquely identify a web browser on a given computer, and not to identify a person. The information saved by the cookie concerning the use of our website (including the IP address) is generally transmitted to a Google server in the United States and is saved there. We draw your attention to the fact that Google AdWords (remarketing) has been completed by the code "gat._anonymizeIp();" on this website in order to guarantee the anonymous input of IP addresses ("IP masking"). As a result, Google – at our request – enters your IP address only in a truncated way, guaranteeing anonymity and preventing any deduction concerning your identity. If IP anonymity is activated on this website, your IP address is previously truncated by Google in a member state of the European Union or in another state which has signed up to the European Economic Area. In some exceptional cases only, the complete IP address is transmitted to a Google server in the United States and then truncated.
You can prevent these cookies from being registered in the settings of your web browser; but we would point out that in this case you may not be able to use the website's features to the full. Moreover, in your web browser you can deactivate customised advertisements on Google and customised Google advertisements on the internet (within the Google display network) by visiting Ad personalization by clicking, respectively, the Account Status section and on the link "Cancel my account". You can also deactivate customised advertisements using an opt-out feature by going to Network advertising. An opt-out cookie will be installed on your computer.
Adjust
MyTrueCompanion also uses the "adjust" analysis technology provided by the company adjust GmbH, Saarbrücker Str. 37A, 10405 Berlin ("adjust"). For analyses, adjust makes use of users' IP and Mac addresses. The addresses are used anonymously. They can never lead to identifying individuals.
Crashlytics (Fabric)
Apps for smartphones by MyTrueCompanion use the Crashlytics tool, which is part of Twitter's Fabric platform, in order to record application crashes. Crashlytics is a subsidiary of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. No data of a personal nature are transmitted. Only real-time crash reports are sent with precise details concerning code positions and information about the device; these reports aim to simplify maintenance and thus improve the application's stability. Smartly
MyTrueCompanion uses the Smartly.io tool to create and manage Facebook and Instagram advertisements. Smartly.io is a service provided by Solutions Inc. with headquarters at Elielinaukio 2 G, 00100 Helsinki, Finland. Whenever a user is directed towards the MyTrueCompanion website, after clicking on an advertisement for MyTrueCompanion on Facebook or Instagram, the following data can be collected and transmitted to Facebook: 1) identification of the Facebook ad, 2) timestamp of click on the Facebook ad. Smartly can then consult these data, which are collective and have no link to individuals. We draw your attention to the fact that to use this tool, we have configured the settings so that no user data of a personal nature can be transmitted to Smartly. Facebook Connect
We provide the option to connect to our service via Facebook Connect, Facebook Inc., 1 Hacker Way, 94025 Menlo Park, CA, USA, Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland. In this case, an additional registration is not possible. To log in, you are redirected towards the Facebook site, where you can log in with your username. In this way, your Facebook profile and our service are linked together. Through this link, we automatically obtain the following information from Facebook Inc.: age range, date of birth, e-mail, first name, last name, gender, Facebook username, link towards the Facebook profile, language, photo, time zone, Facebook profile confirmed, access tokens, signed request.
Among these data, we only use the following: date of birth, e-mail, first name, gender, photo, access tokens, signed request. This information is essential for the terms of the contract in order to identify you.

Facebook SDK
We use the SDK developers' tool produced by Facebook Inc., 1 Hacker Way, 94025 Menlo Park, CA, USA, Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland ("Facebook SDK") in relation to the application. Facebook SDK is used to analyse user behaviour anonymously and to measure the active users and their behaviour (e.g. posts, answers, votes). This never gives us any access to Facebook data or to the users' Facebook accounts. Cookies
Part of the MyTrueCompanion service makes it necessary to use what are known as "cookies". Consequently, MyTrueCompanion explicitly attracts the customer's attention to the use of cookies.
Cookies are small text files that are temporarily installed in the computer memory ("session cookies") or saved on the computer hard drive ("permanent cookies"). The cookies contain, for example, information about the user's previous visits to the corresponding server, information about the offers seen until then or about the means of payment accepted during previous transactions. By registering customised settings on websites, the main aim of cookies is to make available specially adapted offers to the customer and to make the service as user-friendly as possible, given that the customer can visit different websites without having to accept all the settings at each visit. Cookies are never used, however, to run programmes independently or even to place viruses on the customer's computer.
MyTrueCompanion uses session cookies, partner and affiliate cookies and permanent cookies.
Session cookies:
MyTrueCompanion uses what are known as "session cookies". They are not saved on the client's computer hard drive and are deleted when the user closes the web browser. Session cookies are used in particular for authentication via the login during the registration process.
Cookie partners and affiliates:
MyTrueCompanion also uses what are known as "partner cookies" and "affiliate cookies". By this we mean that cookies are deposited when a customer accesses the MyTrueCompanion service through the intermediary of a partner's advertisement. These cookies are used to make calculations about billing with the partner and contain no information about the customer of a personal nature. They are automatically deleted either when the customer signs up on the MyTrueCompanion website or when the respective cookie's lifespan is over.
Permanent cookies:
MyTrueCompanion uses what are known as "permanent cookies" to save the personal settings selected by the customer when using the MyTrueCompanion service. First, this helps to guarantee that the customer will access their customised settings when they revisit the MyTrueCompanion website; second, it helps to automatically distinguish the customer's membership status and to find out whether they have already seen information and advertising measures or have taken part in a survey. Permanent cookies are used to customise and improve the MyTrueCompanion service.
Partner websites:
To the extent that the MyTrueCompanion service is integrated into a partner's website, these partners may also make use of cookies. MyTrueCompanion has no control at this level and is not responsible for the activity of its partners. So, for clients' own security, MyTrueCompanion recommends that its clients find out about the data protection measures of the respective partners. The same holds when customers access a partner's website through the intermediary of the MyTrueCompanion website or applications.
Most web browsers are configured by default to accept cookies. However, customers have the right and the responsibility to configure their web browser so that it will refuse cookies or at least that the system requests customers' confirmation beforehand. If the customer decides to refuse or to deactivate cookies, the full scope of MyTrueCompanion services may be restricted and some features will not be fully operational.
Contract pricing conditions
Using the MyTrueCompanion involves signing up for the service before using it. It is free to sign up and to take the love compatibility test. Customers agree to a free contract with MyTrueCompanion.fr based on the general terms and conditions. To receive the results of the love compatibility test there is a charge of 3.90 euros including VAT. The fee to sign up on the site is 20 euros including VAT, payable on the date customers access the results of the test. Once this payment has been made, the customer will have access to the customer interface, providing customised assistance in developing their relationship. Customers will have 3 recommendations to be followed every 14 days and adapted to the results of their test. Along with the results of the customised recommendations, other tips will follow, and so on. This service is invoiced at 19.90 euros a month including VAT for a minimum of 3 months. At the end of the three months, the service is renewed by tacit agreement. The first month of subscription will be debited on the day the contract is subscribed.
By agreeing to the general terms and conditions, the customer accepts the contract conclusions given above and cannot dispute the resulting fees. If customers wish to cancel their subscription, they should send a registered letter to LMDS USA LLC, 517 Arthur Godfrey Road, Office 500, Miami Beach, FL, 33140 expressing their wish to cancel the subscription. The request for cancellation can only be made with a notice period of three months from the date of the registered letter and only if the cancellation date occurs after the obligatory three-month period validating the contract and/or the general terms and conditions. If customers cancel their contract in the first three months of the contract, the request will be taken into account at the end of the obligatory three-month period.
Declaration of agreement:
By agreeing to this contract, I consent to my personal data being collected and processed for the reasons mentioned above by the company Lmds Usa Llc., Lmds Usa Llc, 517 Arthur Godfrey Road, Office 500, Miami Beach , FL, 33140
or by third parties acting in the name and on behalf of the Lmds Usa Llc company.
I have been informed that this consent has been registered by the Lmds Usa Llc. company.
Moreover, I have been notified that personal data collected about myself as part of the purposes given above are processed in line with the General Data Protection Regulation (GDPR).

Agreement to data processing for advertising purposes.
I agree for the MyTrueCompanion company to send me information adapted to myself and concerning new or complementary products. This also includes advertising from partner companies of the MyTrueCompanion company.
I have been informed that I can at any time freely withdraw my consent for my data to be saved and for their use in sending out advertisements. This withdrawal of consent will take future effect, without it having any negative consequences for myself. To do so, please send an email to info@my-true-companion.com, mentioning the email address given to the MyTrueCompanion company, the country, the MyTrueCompanion service used by the customer and the username (or the identifier attributed to the customer).
